The terms “we,” “us,” and “our” refer to SpoodyHouse. SpoodyHouse operates this website and online store, including the information, content, features, tools, products, and services made available through it (collectively, the “Services”).

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service (“Terms”), together with the policies referenced in them, describe your rights and responsibilities when accessing or using our Services or purchasing products from SpoodyHouse.

Please read these Terms carefully before using our Services or placing an order. They contain important information regarding handmade products, orders, payments, shipping, cancellations, returns, replacements, refunds, privacy, and other rights and responsibilities.

By accessing, browsing, interacting with, or purchasing through our Services, you agree to be bound by these Terms and the policies incorporated into them, including our Privacy Policy, Shipping Policy, and Return, Replacement & Refund Policy.

If you do not agree to these Terms, please do not use or access the Services.

Nothing in these Terms is intended to limit, exclude, restrict, or waive any consumer rights that cannot legally be limited, excluded, restricted, or waived under applicable law.

SECTION 1 - ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your state, province, country, or place of residence, or that you are the age of majority and have given permission for any minor dependents under your supervision to use the Services on devices you own or manage.

To use certain parts of the Services or purchase products from our store, you may be required to provide information such as your name, email address, billing information, payment information, and shipping address.

You agree that the information you provide is accurate, current, and complete and that you have the right to provide and use such information.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.

You may not transfer, sell, assign, or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to accurately describe and represent our products, including their appearance, dimensions, materials, features, included components, colors, designs, themes, and available options.

Handmade & 3D-Printed Products

SpoodyHouse products are handmade, produced in small batches, or made to order and may include 3D-printed and hand-assembled components.

Because of the nature of handmade and 3D-printed production, minor variations may naturally occur from one product to another. These may include slight differences in surface texture, 3D-print layer appearance, finish, color, dimensions, or other minor handmade characteristics.

These minor variations are not considered defects when they do not materially affect the product's stated usable dimensions, fit, intended function, safety, durability, compatibility, or overall appearance.

We carefully inspect our products before shipment.

If you believe your product has a manufacturing defect rather than a normal handmade variation, please contact us in accordance with our Return, Replacement & Refund Policy.

Product Images & Colors

We make reasonable efforts to ensure that product images, videos, renders, and other visual representations accurately reflect our products.

However, colors and certain visual details may appear slightly different depending on photography, lighting conditions, screen settings, display calibration, and the device used to access our store.

Minor visual differences caused by these factors do not necessarily indicate that a product is defective or incorrect.

This does not affect your protection if the product you receive is materially different from what you ordered.

Product Information

Product dimensions, materials, specifications, included components, available colors, themes, personalization options, and other relevant information are provided on the applicable product page.

Please review this information carefully before placing your order.

Minor manufacturing tolerances may occur in handmade or 3D-printed components. Such variations are not considered defects when they do not materially affect the product's stated usable dimensions, fit, intended function, safety, durability, or compatibility.

If your order arrives damaged, defective, incomplete, incorrect, or materially different from what you ordered, please refer to our Return, Replacement & Refund Policy.

Product Availability & Changes

We may update product descriptions, specifications, available options, pricing, or availability from time to time.

We may also discontinue products, colors, themes, customization options, or other product variations, or limit available quantities where reasonably necessary.

Changes made after an order has been accepted will not materially alter the product specifications or options confirmed in that order without your agreement, except where reasonably necessary and permitted by applicable law.

SECTION 3 - ORDERS AND CANCELLATIONS

When you place an order with SpoodyHouse, you are making an offer to purchase the products and options selected in your order.

Please carefully review your:

• Product selection
• Size and dimensions
• Color
• Theme
• Design
• Personalization
• Quantity
• Shipping address; and
• Contact information

before completing your purchase.

You are responsible for ensuring that the information and options submitted with your order are correct.

We may accept or decline an order. An order is accepted when we send an order confirmation or otherwise confirm acceptance. Payment authorization or collection alone does not necessarily require us to accept an order where we are legally entitled to decline or cancel it.

24-Hour Cancellation Window

We understand that mistakes can happen when placing an order.

You may request to cancel your order within 24 hours after placing it, provided the order has not already been shipped.

After the 24-hour cancellation window expires, cancellation is no longer guaranteed because production, preparation, assembly, or customization of your handmade order may already be underway.

To request a cancellation within the 24-hour window, please contact us as soon as possible at:

If your cancellation request is received within 24 hours of purchase and your order has not shipped, we will honor the cancellation request.

After the 24-hour cancellation window, we may be able to accommodate a cancellation request at our discretion if the order has not yet shipped.

Once an order has been shipped, it can no longer be canceled.

If an order is successfully canceled after payment has been collected, any applicable refund will be issued to the original payment method.

The 24-hour cancellation window applies before shipment and is separate from our 15-Day Order Protection, which applies after delivery to eligible product or delivery issues.

Handmade & Made-to-Order Production

Many SpoodyHouse products are handmade, produced in small batches, or made to order.

Production, preparation, assembly, or customization may begin shortly after your order is accepted.

Personalized or custom-made products are eligible for cancellation within 24 hours of purchase if they have not yet shipped. Requests to modify these products may not be possible once production or customization has begun.

Order Modifications

The 24-hour cancellation window does not guarantee that every modification request can be completed.

If you need to change a product option, shipping information, personalization, or another order detail, please contact us as soon as possible.

We will make reasonable efforts to accommodate the request if production, preparation, customization, or shipment has not progressed too far to reasonably make the requested change.

Change-of-Mind Returns

Because SpoodyHouse products are handmade, made to order, or produced in small batches, we do not accept returns or exchanges solely because you change your mind after receiving your order.

This includes situations where you:

• No longer want or need the product
• Prefer another product, color, theme, or design
• Selected the wrong size, color, theme, design, or product option; or
• Ordered an item by mistake

when the product delivered correctly matches the order you placed.

If you realize you made a mistake after placing your order, please use the 24-hour cancellation window described above.

This restriction does not affect your protection if your order arrives damaged, defective, incomplete, incorrect, or materially different from what you ordered.

Returns, replacements, and refunds are handled in accordance with our Return, Replacement & Refund Policy and any rights available to you under applicable law.

Order Cancellations by SpoodyHouse

We may decline, limit, or cancel an order where reasonably necessary, including in cases involving:

• Suspected fraud
• Payment issues
• Material pricing or technical errors
• Incorrect product information
• Product or material unavailability
• Shipping restrictions; or
• Other circumstances that reasonably prevent us from fulfilling the order.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

SECTION 4 - PRICES AND BILLING

All product prices are displayed in U.S. dollars (USD) unless otherwise stated.

We aim to provide clear and transparent pricing.

The total amount displayed at checkout is the final amount you will pay for your order.

You will not be charged additional shipping, handling, customs, import, or delivery fees after completing your purchase.

Orders of $35 USD or more qualify for free U.S. shipping.

For orders under $35 USD, the applicable shipping charge will be clearly displayed and included in your order total at checkout before you complete your purchase.

Any applicable costs associated with delivering your order are included in the final amount shown at checkout.

You will not be required to pay additional customs duties, import fees, handling charges, or delivery fees when your order is delivered.

Prices, discounts, and promotions may change from time to time. However, once your order has been successfully placed, the price applicable to that order will be the price confirmed at checkout, except in the case of an obvious pricing or technical error.

You agree to provide accurate, current, and complete billing and payment information.

You represent that you are authorized to use the payment method submitted with your order and agree to pay the total amount displayed and authorized at checkout.

If we identify a material pricing or technical error affecting your order, we will make reasonable efforts to contact you before making a material change.

If we are unable to fulfill the order at the confirmed price, the affected order may be canceled and the applicable amount refunded to the original payment method.

SECTION 5 - SHIPPING AND DELIVERY

Processing and delivery times displayed by SpoodyHouse are estimates unless expressly stated otherwise.

Because our products are handmade or made to order, processing time may include the time required to produce, assemble, inspect, prepare, and package your order.

Delivery delays may occasionally occur due to shipping carriers, customs processing, weather, holidays, transportation disruptions, incorrect delivery information, or other circumstances outside our reasonable control.

We will make reasonable efforts to prepare and ship your order within the processing timeframe stated on our website.

Please ensure that your shipping address and contact information are complete and accurate before placing your order.

If you discover an address error, please contact us as soon as possible. We cannot guarantee that an address can be changed after an order has been shipped.

SpoodyHouse is not responsible for delays or delivery problems caused by incorrect or incomplete shipping information provided by the customer.

If an order is returned because of an incorrect or incomplete address provided by the customer, additional shipping costs may apply before the order can be shipped again.

If your order arrives damaged, defective, incomplete, incorrect, or materially different from what you ordered, please contact us within 15 days of delivery in accordance with our Return, Replacement & Refund Policy.

Verified shipping damage and other eligible order issues remain protected under our 15-Day Order Protection.

Please refer to our Shipping Policy for additional information regarding processing, shipping, tracking, delivery, and related matters.

SECTION 6 - RETURNS, REPLACEMENTS AND REFUNDS

The 15-Day Order Protection is not a general 15-day change-of-mind return period.

Because SpoodyHouse products are handmade, made to order, or produced in small batches, we do not accept returns or exchanges solely because of a change of mind after delivery.

However, if your order arrives:

Damaged;
Defective;
Incomplete;
Incorrect; or
Materially different from what you ordered,

you may be eligible for protection under our Return, Replacement & Refund Policy.

Eligible order issues must be reported within 15 days of delivery.

Claim Evidence

Claims involving damage, defects, missing components, or incorrect products require supporting evidence in accordance with our Return, Replacement & Refund Policy.

Depending on the issue, this may include:

• A continuous unboxing video
• Clear photographs or videos of the issue
• Photographs or video of the shipping package and protective packaging where relevant
• Proof of purchase; and
• Other information reasonably necessary to verify the claim.

Claim evidence is handled in accordance with our Privacy Policy.

Nothing in these evidence requirements is intended to limit consumer rights that cannot legally be waived or restricted under applicable law.

Approved Order Issues

Once an eligible issue is verified, we will make it right at no additional cost to you.

Depending on the circumstances, the appropriate resolution may include:

• A replacement product
• A replacement component; or
• An approved return and refund.

If a replacement is provided, SpoodyHouse covers the approved replacement shipping cost.

If a return is required for an approved eligible claim, SpoodyHouse covers the approved return shipping cost.

U.S. Return Warehouse

Approved product returns are sent to our designated U.S. return warehouse.

The correct return address and return instructions will be provided by email only after your return has been reviewed and authorized.

Do not send any product back without first contacting SpoodyHouse and receiving return authorization and the correct return address.

Do not return products to the original shipping address unless we specifically instruct you to do so.

Unauthorized returns, returns sent to an incorrect address, or returns that do not follow the provided return instructions may not be accepted or eligible for a refund.

The use of a U.S. return warehouse does not mean that SpoodyHouse is established or operates as a U.S. business.

Please refer to our Return, Replacement & Refund Policy for complete claim, return, replacement, and refund requirements.

SECTION 7 - INTELLECTUAL PROPERTY

The content available through the Services, including trademarks, brand names, logos, text, graphics, photographs, videos, product images, layouts, and other materials owned by SpoodyHouse or its applicable licensors may be protected by applicable intellectual property laws.

You may access and use the Services for personal, non-commercial purposes.

Except where permitted by applicable law or with our prior written permission, you may not reproduce, distribute, modify, republish, display, sell, commercially exploit, or create derivative works from protected SpoodyHouse content.

Nothing in these Terms transfers ownership of our intellectual property to you.

Nothing in this section claims intellectual property rights beyond those that SpoodyHouse or its applicable licensors legally own or are entitled to enforce.

SECTION 8 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, applications, payment services, or other functionality operated by third parties.

Third-party services may be subject to their own terms of service and privacy policies.

We do not control independent third-party services and are not responsible for their independent acts or omissions except where applicable law provides otherwise.

Please review the relevant third-party terms and policies before using those services.

We may introduce additional tools, features, or resources in the future. Unless otherwise stated, those features will form part of the Services and will be subject to these Terms.

SECTION 9 - THIRD-PARTY LINKS

Our Services may contain links to websites, services, social media platforms, or resources operated by third parties.

We are not responsible for the content, accuracy, availability, policies, security, or practices of independent third-party websites or services, except where applicable law provides otherwise.

If you choose to access or use a third-party website or service, your use will generally be subject to that third party's terms and policies.

Questions, complaints, or claims regarding products or services purchased directly from an independent third party should generally be directed to that third party.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

SpoodyHouse is powered by Shopify, which provides the ecommerce platform used to operate our online store.

Purchases made from SpoodyHouse are transactions directly between you and SpoodyHouse.

Shopify provides technology and services that support our store and may process information or transactions as described in our Privacy Policy and Shopify's applicable terms and policies.

Shopify is not the seller or manufacturer of SpoodyHouse products and does not produce or fulfill our handmade products.

Nothing in this section limits any responsibility that Shopify or SpoodyHouse may have where such responsibility cannot legally be excluded under applicable law.

SECTION 11 - PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

This may include information associated with:

• Orders and transactions
• The 24-hour cancellation process
• Payments and refunds
• Shipping and delivery
• Customer support
• 15-Day Order Protection claims
• Continuous unboxing videos and other claim evidence
• Approved returns
• Replacements; and
• Refunds.

Because our store is powered by Shopify, certain personal information may also be processed by Shopify and other service providers that help us operate our store, process payments and refunds, fulfill orders, prevent fraud, provide shipping and return services, provide customer support, and maintain the Services.

Please review our Privacy Policy for more information about how personal information is collected, used, disclosed, retained, and protected.

SECTION 12 - FEEDBACK, REVIEWS AND CUSTOMER CONTENT

If you voluntarily submit feedback, suggestions, reviews, photographs, videos, or other content for review, testimonial, promotional, or similar purposes, you grant us permission to use, reproduce, display, and share that content for purposes such as operating, improving, and promoting our Services, subject to applicable law.

You represent that you have the necessary rights to content you voluntarily submit for these purposes and that the content does not unlawfully violate another person's rights.

We may remove content that is unlawful, fraudulent, abusive, defamatory, infringing, misleading, or otherwise violates these Terms, where permitted by applicable law.

Nothing in this section requires you to provide feedback or prevents you from providing an honest review of your experience with SpoodyHouse.

Claim Evidence Is Different

Photographs, videos, continuous unboxing videos, packaging evidence, and other materials submitted specifically for customer support, 15-Day Order Protection, returns, replacements, or refunds are treated as claim evidence.

Submitting claim evidence does not by itself give SpoodyHouse permission to use that evidence for advertising, social media, testimonials, or other promotional purposes.

We will handle claim evidence in accordance with our Privacy Policy.

This distinction is important because the Privacy Policy you uploaded already says claim evidence is for claim administration and will not be used in promotional materials without permission.

SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our Services may contain typographical errors, inaccuracies, or omissions relating to:

• Product descriptions
• Specifications
• Pricing
• Promotions
• Shipping charges
• Estimated processing or delivery times; or
• Product availability.

We reserve the right to correct such errors and update information where reasonably necessary.

If an error materially affects an order you have already placed, we will make reasonable efforts to contact you before making a material change to the order.

If we are unable to fulfill an order as confirmed because of a material error, we may cancel the affected order and refund the applicable amount to your original payment method.

SECTION 14 - PROHIBITED USES

You may access and use the Services only for lawful purposes.

You may not use the Services to:

• Violate applicable laws or regulations
• Infringe our intellectual property rights or the rights of others
• Engage in fraud or knowingly submit false or misleading information
• Submit fraudulent or duplicate order-protection claims
• Impersonate another person or entity
• Transmit viruses, malware, or other harmful code
• Unlawfully collect or use another person's personal information
• Interfere with the security, operation, or functionality of the Services
• Circumvent security or access-control measures; or
• Engage in conduct intended to unlawfully harm SpoodyHouse, Shopify, our customers, or other persons.

We may restrict or suspend access where reasonably necessary to protect our Services, customers, business, or legal rights.

SECTION 15 - AUTOMATED ACCESS

Automated systems, bots, scraping tools, data-extraction systems, or similar technologies may not access or interact with the Services in a manner that circumvents security measures, access restrictions, CAPTCHAs, robot exclusion controls, or other technical protections.

Automated systems must not intentionally misrepresent automated activity as human activity or attempt to bypass measures intended to distinguish automated activity from human use.

We may restrict automated access where reasonably necessary to protect the operation, security, availability, or integrity of the Services.

SECTION 16 - TERMINATION

We may suspend or terminate access to all or part of the Services where reasonably necessary, including where these Terms have been materially violated, fraudulent or unlawful activity is reasonably suspected, or continued access creates a material security or operational risk.

Termination or suspension of access to the Services does not eliminate rights or obligations relating to orders already accepted by SpoodyHouse.

In particular, termination or suspension does not eliminate applicable rights relating to:

An eligible cancellation already being processed;
An accepted order;
An eligible 15-Day Order Protection claim;
An approved return;
A replacement; or
An approved refund.

Provisions that by their nature should continue after termination will remain in effect.

SECTION 17 - DISCLAIMER OF WARRANTIES

We make reasonable efforts to maintain accurate, secure, and reliable Services.

However, we cannot guarantee that our website or other digital Services will always be uninterrupted, error-free, secure, or continuously available.

Except as expressly stated in these Terms, our product descriptions, or our Return, Replacement & Refund Policy, the digital Services are provided on an “as available” basis to the fullest extent permitted by applicable law.

Nothing in this section limits the protections expressly provided under our Return, Replacement & Refund Policy, including protection for eligible products that arrive damaged, defective, incomplete, incorrect, or materially different from what you ordered.

Minor variations inherent to handmade or 3D-printed production are not considered defects when they do not materially affect the product's stated usable dimensions, fit, function, safety, durability, compatibility, or overall appearance.

To the fullest extent permitted by applicable law, we disclaim warranties that may otherwise arise by implication, except where such warranties cannot legally be excluded or where we have expressly provided otherwise.

SECTION 18 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, SpoodyHouse will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Services or our products where such liability may legally be limited.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Nothing in this section limits SpoodyHouse's obligations under our Return, Replacement & Refund Policy or other obligations that cannot legally be restricted, including our obligation to provide the applicable resolution for an approved eligible claim.

SECTION 19 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold SpoodyHouse harmless from third-party claims, losses, damages, or liabilities resulting from your unlawful use of the Services, material violation of these Terms, or infringement of another person's rights.

This section does not apply to claims resulting from SpoodyHouse's own obligations to you under applicable law or our policies.

SECTION 20 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or severed where necessary.

The remaining provisions will continue in full force and effect.

SECTION 21 - WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with our:

• Return, Replacement & Refund Policy
• Privacy Policy
• Shipping Policy; and
• Any other terms or policies expressly incorporated by reference

constitute the agreement governing your use of the Services and purchases from SpoodyHouse.

Nothing in this section limits rights that cannot legally be waived under applicable law.

SECTION 22 - ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent where such consent is legally permitted to be required.

SpoodyHouse may transfer or assign its rights or obligations where reasonably necessary in connection with the operation, restructuring, sale, or transfer of the business, subject to applicable law.

SECTION 23 - GOVERNING LAW

These Terms and transactions between you and SpoodyHouse will be governed by and construed in accordance with the laws of Vietnam, without limiting any mandatory consumer protection rights that may apply to you under the laws of your place of residence.

Nothing in these Terms is intended to exclude, restrict, or waive any consumer rights that cannot legally be excluded, restricted, or waived under applicable law.

SECTION 24 - CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our:

• Services
• Products
• Policies
• Shopify or other service providers
• Shipping or return arrangements
• Business operations; or
• Legal obligations.

The most current version of these Terms will be available on this page.

Where required by applicable law, we will provide notice of material changes.

Changes to these Terms will not retroactively remove rights applicable to orders placed before the change where such rights cannot legally be altered.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
